ESOS Act 2000 Integrity Amendments 2025 — International Student Protections Strengthened

The Education Services for Overseas Students (ESOS) Integrity Amendments 2025 introduced the most significant changes to Australia's international student framework since the original ESOS Act 2000. The amendments came into effect in late 2025 and are now fully operational.

Key Changes for International Students

1. Strengthened Provider Accountability

The 2025 amendments increase CRICOS provider obligations around student welfare, course progress monitoring, and transparent communication of student rights. Providers must ensure students have ready access to their rights — including information about complaints processes, refund entitlements, and Tuition Protection Service (TPS) coverage.

2. Enhanced Tuition Protection

The amendments strengthen the Tuition Protection Service (TPS) framework. If a CRICOS provider ceases to deliver a course, affected students are entitled to either a placement at an equivalent provider or a refund of their unused tuition fees. The 2025 changes improve the speed and clarity of these protections.

3. Agent Oversight Requirements

CRICOS providers now have stronger obligations to manage and monitor their education agent networks. Agents must be registered, trained, and operating under compliant written agreements. Providers bear responsibility for agent conduct that affects student welfare.

4. Student Visa Conditions Alignment

The amendments clarify how ESOS obligations align with student visa conditions — particularly around course progress, attendance, and reporting to the Department of Home Affairs through PRISMS.
